Terms and Conditions

 1.      Definitions: In these terms and conditions, the following terms have the meanings stated below:

‘Attendee’ refers to an adult participant attending the session.

‘Child’ refers to a child attending the session.

‘Parent’ means the parent or guardian of a child registered to attend ‘Sessions’ at Big Hearted Living.

‘Session’ refers to any event, course, workshop taking place either online or in a Venue.

‘Venue’ refers to the Venue at which a ‘Session’ is taking place.

‘SL’ refers to ‘Session Leader’: the designated person in charge of leading a course, event, workshop.

‘BHL’ refers to Big Hearted Living Ltd, a limited liability partnership incorporated in England with registration number 13179370. Big Hearted Living is the registered company under which Be more giraffe is trading.

2.      Parties: This agreement is between the Parent or Attendee and BHL. If booking an event for a child, all bookings must be made by the Parent responsible for the child.

3.      Safety and care (In-Venue bookings)

a.      You, the Parent agree to organise your Child’s prompt arrival at and collection from the Venue.

b.      If you are not collecting your Child from the Venue, you must notify the programme leaders in advance of the name and contact number for the person who will be collecting them.

c.       If driving to the Venue, please park considerately and safely. We are not liable for any damage to vehicles whilst parked at the Venue; nor can we be held responsible for any injury to persons whilst moving between their vehicle and the Venue.

d.      Attendees, Parents and Children must treat all programme leaders, session attendees and other people at the Venue with respect and consideration. We do not tolerate rude, offensive or aggressive remarks and behaviour in any way.

e.      Attendees, and Parents: please make yourself (and your Child) aware of the health and safety rules of the Venue and comply with these at all times.

4.      Digital imagery permission:

a.      From time to time, we would like to take photographs and some video footage of the sessions.

b.      We will only take photographs or videos of Attendees or Children if we have been given prior permission by the Attendee/Parent.

c.       If you grant us permission to take photographs or videos of your or your child, please tick the digital imagery permission box on the booking form.

d.      By giving permission you are giving full rights to use the images, and any reproductions of the images, for marketing materials that include, but may not be limited to, newsletters, digital images on our website and social media pages, and printed materials such as flyers and posters.

5.      Medical conditions, medication and treatments

a.      The Parent shall notify us in writing at registration if the Child suffers from any medical injury, condition (including any allergies) or disability that ought properly to be brought to our attention so that an assessment of the needs of the Child can be made. Parents are responsible for informing us of any changes to their Child’s circumstances.

b.      In the event that we are notified that an Attendee or Child has an allergy (or other similar condition), we will, if specifically instructed by the Attendee/Parent, take reasonable precautions to protect the Attendee/Child from exposure to the cause of the allergy (or other similar condition) but we cannot guarantee non-exposure.

c.       Attendees / Children must not attend a session if you/they have any known or suspected condition which may be contagious.

d.      If a contagious condition is suspected, Attendees/Children should not attend any session during the period in which they could be incubating the condition or at any point after contracting the condition when they could still be contagious.

e.      Any Attendee/Child who is showing any symptoms of a flu-like illness should stay away from sessions until they are fully recovered and free of symptoms.

f.        In the instance of sickness or diarrhoea, the Attendee/Child must have been clear of all symptoms for at least 48 hours before attending a session.

g.      We reserve the right to refuse entry to an Attendee/Child or to ask the Parent to pick up their Child before the end of a session if they are displaying any symptoms of illness that may be contagious or if they appear not well enough to be attending the session.

6.      First aid and medical treatment permission:

a.      We request the Attendee / Parent, to authorise the course leaders, who are trained in the basics of first aid, to administer first aid when deemed necessary and as appropriate to the situation.

b.      If you grant this permission, in the event of an emergency requiring medical attention, you hereby authorise us to telephone for an ambulance and, if necessary, to transport you/your Child to the nearest medical care facility and to secure necessary medical treatment for you/your Child.

c.       If the participant is a Child, we will do our best to contact the Parent/emergency contact as soon as possible.

d.      In order to authorise the above, you/the Parent, must tick the medical permission box on the booking form.

7.      Payment terms:

a.      The fees and payment terms for each event, course or programme are as stated on our website.

b.      We reserve the right to cancel your place if you do not make the fee payments when due.

8.      Cancellations and Amendments to Sessions by BHL:

a.      BH: will always endeavour to run all Sessions, however, there may be occasions when we need to cancel a course, e.g. due to staff illness, venue issues or other unforeseen circumstances.

b.      If the SL is unable to lead a Session, where possible, an alternative SL will take the Session, however, if we are unable to adequately staff a Session, we reserve the right to reschedule or cancel it.

c.       BHL reserves the right to either move a Session online or change a Session Venue to a nearby alternative Venue. In the event of a Venue change, Attendees or Parents will be notified as soon as possible. If it is not possible to run the Session online or in an alternative Venue, BHL reserves the right to cancel the Session.

d.      A minimum number of Attendees/Children are required for a Session to be viable to run and this number varies according to the type of Session, date and Venue. In the event of insufficient bookings, BHL reserves the right to cancel and will issue a full refund to all those already booked onto the course.

e.      In the event that a Session is cancelled due to the fault of BHL, an alternative date will be offered, where possible. If no alternative date can be offered, a refund will be given.

f.        Where any cancellation or amendment is necessary, the Attendee/Parent will be notified as soon as possible via email or telephone.

g.      We are not liable for Sessions cancelled due to circumstances beyond our control such as adverse weather conditions, war, pandemics etc. If such events lead to the cancellation of lessons, no refund will be given. However, we will always do our best to offer online or alternative Sessions wherever possible.

h.      In the event of government restrictions or lockdowns meaning that we are unable to run Sessions in Venues, all Sessions will automatically default to online. In these circumstances, no refunds or fee reductions will be given.

9.      Cancellations and amendments by the Parent or Attendee: Due to the varied nature of the Sessions, each Session has different cancellation policies. These can be found in the bookings section for that Session on the website.

10.  Complaints:

If you have a complaint or concern, please speak to one of the course leaders or email us on hello@bemoregiraffe.com.

11.  We are not liable for any direct, incidental, consequential, indirect, special, punitive or similar damages arising out of use of our services, or any errors or omissions in the content of our materials. You, the Attendee or Parent, specifically waive any and all claims arising out of the use of this service.

12.  Copyright: All materials created in-house are copyright. You agree that you will not publish or distribute any portion of any materials without prior written permission from us.

13.  Data processing: 

a.      We will process your personal data in accordance with current UK data protection legislation. We will not share your personal data with any third party unless it is in furtherance of the performance of our duty of care and/or to deliver our contract terms.

b.      As well as a legal requirement, it is in your interests that the data we process is accurate and kept up to date. You agree that you will inform us promptly of any changes to the data we process in respect of our students and we will update our records accordingly.

c.       It is possible that during the course of our business we will process ‘special category’ data about your child. For further information on how we process your personal data please refer to the privacy policy on our website.

14.  Exclusion and Limitation of Liability

a.      Without prejudice to clause

b.      Big Hearted Living’s maximum aggregate liability for breach of these Terms and Conditions (including any liability for the acts or omissions of its employees, consultants or agents), whether arising in contract, tort (including negligence), misrepresentation or otherwise, shall in no circumstances exceed the amount of the session fee paid by the parent/carer to BHL for the session.

c.       Nothing in these Terms and Conditions shall in any way limit:

d.      either party’s liability for death or personal injury caused by its own negligence;

e.      or any liability which cannot be excluded by law.

f.        Third Parties: Nothing in these Terms and Conditions is intended to give any person any right to enforce any term of these Terms and Conditions which that person would not have but for the Contract (Rights of Third Parties) Act 1999.

15.  General

a.      Nothing in these terms and conditions affect your statutory rights.

b.      We reserve the right to make changes to these terms and conditions.

c.       This agreement is governed by the laws of England and Wales.
